You know, I understand in theory that a court not taking an appeal does not mean it has taken a positon on the issue. I also understand that in reality when the Supreme Court does not take a case about hidden trials, sealed records, and a person who may have been held without any proof of wrongdoing the government takes it as a sign that it can continue doing such things.
