The Commission has opened an investigation as to whether the Spanish and Portuguese telecoms incumbents Telefónica and Portugal Telecom have breached Artilce 101 TFUE through reciprocal non-compete agreement re. their respective home markets. Such obligation has arisen from Telefónica's acquisition of sole control of the Brazilian JV Vivo.
