
In addition to the recent BASE & others and Commission v. Belgium cases mentioned below, the Court of Justice also rendered its judgment in Commission v. portugal on the transposition of the Universal Service Directive.
The Court considers that a national system whereby the incumbent (Portugal Telecom) remains automatically the universal service provider until such time as a procedure is launched for the designation of the universal service provider does not provide enough judidicial certainty and thus fails to comply with the obligations in the Universal Service Directive.
