As expected, the CJEU has confirmed the General court decision in Deutsche Telekom. The case is available here.
The Court confirms inter alia that (i) the as efficient operator test coule be applied (in my opnion, this does not means that a reasonable efficient operator could not apply - see AG 's opinion), and (ii) the principle of equality of opportunities does justify leaving call revenues at bay.
