
The Commission published its comments on the imposition of KPIs in Ireland. The Commission made clear that KPIs are an important for assessing compliance with the non discrimination obligation:
"The Commission would like to stress the importance of ensuring that effective measures are in place to monitor and enforce compliance with nondiscrimination obligations if such obligations are to achieve positive results in the competitive landscape. The introduction of accurate and comparable indicators measuring service quality throughout all stages of provision of services to both the incumbent’s own downstream business and its competitors is, indeed, an appropriate tool to monitor such compliance. Without this transparency it would be more difficult for the national regulator to ensure equal treatment in relation to the key features of the wholesale product and the processes for providing it, which include functionality, quality and reliability along with processes for testing ordering, provisioning and fault repair"
