In the last few months, there have been several interesting court's judgements on the must carry obligation, i.e., the obligation for certain network operators (essentially cable and DSL operators) to carry radio and television broadcasts that are considered of general interest.
In Cases T-385/07, T-55/08 and T-68/08, FIFA and UEFA v Commission of 17 February 2011, the Court held that a Member State may, in certain circumstances, prohibit the exclusive broadcast of all World Cup and EURO football matches on pay television, in order to allow the general public to follow those events on free television.
In Case C‑134/10, Commission v. Belgium of 3 March 2011, the court held that the way the must-carry obligations are applied must be subject to a transparent procedure based on objective non-discriminatory criteria known in advance.
