Consultation on the e-commerce directive


Although not directly linked to telecom market regulation, it is interesting to note the consultation launched on 10 August by the Commission on the e-commerce directive. Response must be submitted for 15 October.


The Commission wishes to consult interested parties directly and receive their reaction and experience on a number of subjects:
1 The level of development, both national and cross-border, of information society services.
2 Issues concerning the application of Article 3(4) by the Member States (administrative cooperation).
3 Contractual restrictions on cross-border on-line sales.
4 Cross-border on-line commercial communications, in particular by the regulated professions.
5 The development of on-line press services.
6 The interpretation of the provisions concerning the liability of intermediary information society service providers.
7 The development of on-line pharmacy services
8 The resolution of on-line disputes.


Section 7 seems most interesting for telcos and ICT compagnies.
