The Commission today decided to refer France and Spain to the EU's Court of Justice because they impose specific charges on telecoms operators. These taxes were introduced to counter-balance the end of paid advertising on public television.
This arguably violates Article 12 of the Authorization Directive and the Albacom line of case-law (see also cases such as telecom Italia). It is indeed arguable that the new autorization Directive has established an exhastive harmonization of the fees that could be asked from telcos.

On the same day, the Commission decided to a request for information to Hungary over its new tax imposed on retail commerce, electronic communications and energy.
