After the judgement clearing former French prime Minister de Villepin in the Clearstream case, Sarkozy is facing another blow on his 55th Birthday as the Commission has opened an infringement procedure against France's telecoms tax. This tax heavily promoted by the French President was imposed on the turnover of telecommunications operators to compensate the termination of public advertising on public channels such as France 2 and France 3. The Commission seems to consider that this tax violates Article 12 of the Authorization Directive. France has now two months to provide a response, before the Commission decide whether to turn to the ECJ.
